Builders are fighting land prices, labor shortages, insurance increases, interest rates, material costs, permitting delays, appraisal gaps, and buyers who are stretched before they even reach the closing table. Add one more federal construction mandate, and a project that barely worked on paper can suddenly stop working at all. That is the background behind HUD and USDA’s 2026 rescission of the 2024 energy code determination. The now-rescinded policy would have pushed covered FHA and USDA new construction toward newer national energy standards, including the 2021 International Energy Conservation Code for single family and low-rise multifamily housing and ASHRAE 90.1-2019 for taller multifamily buildings. Supporters saw lower utility bills, better comfort, and long-term efficiency. Critics saw higher upfront costs, more inspections, code confusion, and fewer homes getting built.
